The Labour Court affirmed the adjudication officer’s decision and dismissed Barbara Maciejewska’s appeal against the finding that her victimisation complaint was not well founded. The determination was dated 19 December 2017. Maciejewska appealed the decision concerning her complaint against her former employer, Tesco Ireland Limited. The Court found it was common ground that Tesco engaged in collective bargaining. Because the law required that the employer not engage in collective bargaining for the Court to consider a complaint under section 8, the statutory condition was not met and the appeal failed; the merits were not decided.
