The Labour Court varied the unfair dismissal award to Megan Healy, reducing it from €21,736 to €13,800. The Court’s determination was dated 1 July 2022 and found that Healy contributed to her dismissal by missing work after her leave request was refused.

Fit 4 Life Gym Limited appealed the adjudication officer’s decision. The employer argued that Healy’s conduct justified dismissal despite procedural shortcomings. Healy said she was dismissed without a disciplinary process or an opportunity to respond. The Court found that the employer had used no disciplinary procedure and had not given her a chance to be heard, making the dismissal unfair. It also found that her failure to attend work contributed to her dismissal. The original award was varied, with compensation set at €13,800.
