The Labour Court varied an adjudication officer’s decision after Nigel Miller’s appeal against Team Obair Recruitment failed. The Court dated its determination 27 June 2022. The appeal concerned a preliminary question about whether Miller could bring an unfair dismissal claim against the employment agency. The Court found Miller was an agency worker assigned to STL Logistic. Under the law, an agency worker’s unfair dismissal remedy lies against the hirer, rather than the employment agency.
