The Labour Court varied an unfair dismissal award to €6,578 for Tomasz Skrzypczak, down from €16,384.68, after finding that Eco-Tech Building Solutions Ltd dismissed him without a fair procedure. The Court’s determination was dated 27 April 2022.
The employer said Mr Skrzypczak had refused work and characterised his conduct as gross misconduct. Mr Skrzypczak disputed refusing work and said he had received no warning, investigation or opportunity to respond before his dismissal.
The Court found that the employer had not used a disciplinary procedure or given Mr Skrzypczak an opportunity to be heard. It concluded that the dismissal was unfair. The €6,578 compensation reflected the 11 weeks he was unemployed. The Court found the employer’s appeal not well-founded, while varying the earlier decision to reduce the award.
