The Labour Court upheld the unfair dismissal finding against Dublin Tech Summit F5 Digital Media Communications Ltd on the employer’s appeal, but reduced Krissie Lundy’s compensation from €16,000 to €7,750. The determination was dated 1 February 2021.

The company said Lundy’s role as Marketing and Communications Manager was made redundant during a restructuring prompted by financial pressure and a need to cut staffing. Lundy said redundancy was not raised before the meeting where she was told she would lose her job.

The Court accepted that the company could restructure and that Lundy’s role was redundant. It found the selection process unfair because she was not told her job was at risk or given a chance to propose alternatives. In setting compensation, the Court considered her efforts to find work and the full-time job she secured in July 2020.
