The Labour Court overturned a finding that Noel Cantwell was fairly dismissed by G4S Secure Solutions (Ire) Limited, ruling that he was unfairly dismissed and awarding him €260. The determination, dated 22 October 2021, followed Cantwell’s appeal against an Adjudication Officer’s decision.
Cantwell had worked as a casual event steward for G4S from 2008. A stadium client told the company in November 2015 not to assign him there again, and he did no further work for G4S after that month. The Court concluded he was dismissed sometime between 12 March and 25 June 2019.
G4S did not attend the hearing, but had submitted that it offered Cantwell work which he refused. The Court could not establish that any offers were made or refused. It found no evidence of a dismissal procedure or of alternative work being offered after the client barred him from the stadium. The Court said reinstatement or re-engagement was inappropriate and set compensation at six months’ pay. It took account of Cantwell’s failure to try to reduce his loss, calculated his average weekly pay at €10 and ordered G4S to pay €260.
