The Labour Court overturned an €11,000 unfair-dismissal award to Pamela Maher on Domestic Cleaning Services Limited’s appeal, finding that a warning letter had not ended her employment. The determination was dated 19 August 2021.

Maher argued that the final written warning raised issues that had not previously been put to her and was issued without fair procedures. Domestic Cleaning Services said a client had raised concerns about her attendance and requested her removal from the site. The company said it offered her work at another location, initially for four hours a day.

The Court found that the 7 October 2019 letter did not say her contract had been terminated. It noted that the company offered continuing employment at a meeting on 14 October, although Maher was dissatisfied with the offer. The Court upheld the appeal and set aside the Adjudication Officer’s decision because it found no basis to conclude that the letter dismissed her.
