Labour Court dismisses John Arkins’s appeal over two late complaints

The Labour Court dismissed John Arkins’s appeal against decisions on his unfair dismissal and minimum notice complaints, finding both were brought outside the time limit. The Court varied the adjudication officer’s decision accordingly. Arkins had been engaged by Kilternan Film Productions Ltd from 26 to 29 April 2016 and referred the complaints to the WRC on 3 April 2019. The Court said it was unnecessary to examine the relationship between Element Pictures Limited and Kilternan Film Productions or the contractual arrangement. The determination was signed on 25 June 2021; the merits were not decided.
