The Labour Court rejected John Comiskey’s unfair dismissal appeal against the Institute of Technology Sligo, affirming the Adjudication Officer’s finding that his complaint was not well founded. The determination was signed on 18 May 2021. Comiskey said a 1999 agreement entitled staff with incomplete pensionable service at 65 to sympathetic consideration of a request to stay in employment. The Court found the clause allowed him to request an extension but did not give him a right to remain. It concluded that he had reached the normal retirement age established by the agreement and workplace practice, so he could not maintain the claim under the Unfair Dismissals Act.
