The Labour Court upheld a €14,000 compensation award to Mary Twohill after Windzor Pharma Ireland Ltd appealed her unfair dismissal case. The determination was dated 4 May 2021.

Twohill’s contract set a 20-hour working week. Windzor said it needed a full-time role and had offered her full-time or commission-based work. Twohill said she had not been told her job was at risk before receiving her dismissal letter.

The Court found the contract allowed changes to her work pattern, not to her contracted hours. Windzor did not engage comprehensively with her before dismissing her, and there was no discernible dismissal procedure or appeal route. The Court found the dismissal unfair and affirmed the original decision, ordering €14,000 compensation after considering her earnings and efforts to find other work.
