The Labour Court found Stephen Redmond’s dismissal by Seetec Employment and Skills Ireland DAC unfair and awarded him €5,400, setting aside the Adjudication Officer’s decision. The determination was dated 8 April 2021.
Seetec said it dismissed Redmond after repeated absences and warnings, while Redmond argued that the disciplinary process was unfair. The Court found that Seetec had issued overlapping final written warnings for the same offence without a basis in its written policy. It said this undermined the process and created uncertainty about the penalties. The Court found Redmond contributed 90% to his dismissal, citing his attendance record, including absences without leave. In setting compensation, it considered his losses and efforts to mitigate them as well as his contribution.
