The Labour Court dismissed Arlandas Kepenis’s appeal against the finding that his unfair dismissal complaint was not well founded. Its determination was dated 29 January 2020. Kepenis sought reinstatement, arguing that a workplace collision caused his injury and that dismissal was disproportionate. Keelings Logistics Solutions said he had breached health and safety procedures while subject to a live final written warning. The Court found he had leaned into a pallet in a confined space without using the manual handling techniques he had been trained in. It also found the investigation and disciplinary process fair, and said the company had reasonable grounds to dismiss him.
