The Labour Court upheld decisions rejecting Kati Kipli’s unfair-dismissal and minimum-notice appeals against Dunnes Stores. The determination was signed on 14 January 2020.
Dunnes Stores dismissed Kipli after she called in sick for a shift and attended and taught her belly-dance class that evening. The Court found shortcomings in the employer’s process, including that Kipli was not given its disciplinary policy and investigation documents. It concluded the flaws did not imperil a fair process, given her admission and the straightforward facts.
Both appeals failed, and the Court upheld the Adjudication Officer’s decisions. It also declined to adjourn the appeals pending separate personal-injury proceedings. Kipli gave no evidence about loss arising from her dismissal without notice.
