The Labour Court overturned the Adjudication Officer’s decision and found Noel Joyce was unfairly dismissed by Parkgate Lounge Limited. It awarded Joyce €5,200 compensation, in addition to statutory redundancy pay already paid. The determination was dated 6 October 2020.

Joyce had worked as a weekend receptionist at the guesthouse. Parkgate Lounge said the role became redundant after it began providing long-term accommodation for people referred by Dublin City Council, changing the front desk’s work to include security. The company said it had offered Joyce a security-focused role and another job at a different guesthouse. Joyce disputed that the meeting offering the security role took place and argued that receptionist work continued.

The Court found substantial overlap between Joyce’s former duties and the continuing front-desk role, with no new qualification required. It concluded that the alleged meeting had not taken place and found the company had not shown that the dismissal resulted from redundancy. The Court set aside the Adjudication Officer’s decision and ordered the compensation payment.
