The Labour Court overturned a €37,500 unfair-dismissal award to Andrea Kiss, upholding United Parcel Service CSTC Ireland Limited’s appeal. The determination was dated 5 March 2020.
Ms Kiss worked as a General Ledger Staff Accountant and was dismissed in July 2017. The employer argued the dismissal was fair and resulted from her conduct; she said it was disproportionate and unfair.
The Court found that emails Ms Kiss sent to two colleagues were highly offensive, inappropriate and unacceptable, and constituted bullying. It said dismissal was within the range of reasonable responses, citing the repeated directions not to contact one colleague and the employer’s efforts to resolve the situation. The Court found she was not unfairly dismissed.
