Labour Court upholds out-of-time decision in Finbar Tymon appeal

The Labour Court upheld the decision that Finbar Tymon’s constructive dismissal complaint against Sse Renewables (Ireland) Limited Trading As Sse Renewables was out of time. The Court determined the appeal on 7 October 2019; the merits were not decided. Tymon argued that efforts to resolve unpaid invoices through an internal grievance justified an extension. The company disputed that explanation. The Court found no link between the grievance process and his delay, and noted he had received legal advice about the six-month time limit.
