The Labour Court declined to hear Glenella Foods Limited Trading As Eurospar’s appeal against a €7,449 unfair dismissal award to Simon King because it was lodged outside the time limit. The determination was dated 16 July 2019; the award remained in place and the merits were not decided.
The employer said a website malfunction prevented its representative from downloading the appeal form on 1 January 2019, the filing deadline. The Court found such malfunctions were regularly encountered and noted that email and fax were available. It ruled that the employer had not shown exceptional circumstances that prevented a timely appeal.
