Labour Court dismisses Joseph Tom Murray’s appeal against Elsatrans Limited

The Labour Court dismissed Joseph Tom Murray’s appeal and upheld the Adjudication Officer’s decision that his unfair dismissal complaint against Elsatrans Limited was outside the time limit. The determination was signed on 11 July 2019. Murray’s solicitor said she had submitted the complaint online in January 2017, but the Court found no evidence that it had been filed then. The WRC had no record of receiving it. A complaint received in October 2017 was five months outside the limit, and the Court found no cogent reason for the delay. The merits of the unfair dismissal complaint were not decided.
