The Labour Court overturned a 16-week-pay compensation order against Drogheda Resource Centre Ltd, finding that Mairead Reilly was not unfairly dismissed. Its determination was dated 10 June 2019. Reilly had said she was forced to resign after mistreatment by her supervisor and the Board’s failure to address her complaints. The employer argued she had not followed its grievance and bullying procedures or given it a proper opportunity to investigate.
The Court found that Reilly had not used the internal procedures to pursue her bullying complaints before resigning, so the employer had not had an opportunity to address them properly. It also considered it inappropriate for the employer to make an investigation conditional on her withdrawing her WRC complaints. The appeal succeeded and the earlier decision was overturned.
