The Labour Court rejected Jacqueline Doyle’s appeal, finding she had not established that Boots Retail (Ireland) Limited dismissed her. The determination was signed on 5 February 2018; the Court did not decide whether a dismissal was fair.
Doyle had worked for Boots since 1997 and was an assistant store manager before disciplinary proceedings in 2016. Boots demoted her to customer assistant, reducing her annual salary from €43,943.46 to €25,057.50. She remained employed by the company.
An Adjudication Officer had found that no dismissal occurred. On appeal, the Court considered that jurisdictional question first and said Doyle had to establish that she had been dismissed before it could consider the fairness of a dismissal. It found she had not met that burden, so it did not proceed to hear the substantive claim.
