The Labour Court dismissed Luka Glogoski’s appeal against the finding that his dismissal by Boots Retail (Ireland) Limited was fair. The determination was dated 30 January 2018. Boots said it dismissed Glogoski for underperformance after a performance improvement plan and disciplinary process. Glogoski disputed the performance concerns and alleged retaliation and a predetermined dismissal. The Court found evidence of performance deficiencies and that Boots followed its policies, gave Glogoski opportunities to respond and used different managers at each stage. It found no evidence of a management agenda to end his employment or a predetermined dismissal. The Court affirmed the Adjudication Officer’s decision that the unfair dismissal complaint was not well founded.
