Labour Court affirms dismissal of Patrick Neville’s complaints against HSE

The Labour Court affirmed the dismissal of Patrick Neville’s three complaints against the Health Service Executive. Its determination was dated 9 February 2018. Neville, managing director of Matrix Resources Limited, argued that the HSE’s move from agency staffing to direct recruitment should have included him. The HSE said he ran Matrix and had never been assigned to work for it. The Court found Neville worked for Matrix, not the HSE, and that vacancy notices to agency workers complied with the law. It found the agency-worker and unfair-dismissal complaints not well founded, and the transfer complaint misconceived because no transfer of undertakings took place.
