The Labour Court raised Lurie Lancu’s unfair-dismissal compensation from €751.92 to €1,024.26, varying the Adjudication Officer’s decision dated 19 July 2018.
Lancu appealed the award calculation, saying his usual earnings were higher than the 40-hour week used to set it. Anglo Beef Processors Ireland Trading As Abp Rathkeale accepted the unfair-dismissal finding but argued the original award was fair, citing average weekly earnings of €361.17 in the 13 weeks before his dismissal.
The Court found that the original weekly-pay calculation did not follow regulations requiring regular overtime earnings to be included. It calculated weekly remuneration at €512.13 and set compensation at twice that amount.
