The Labour Court upheld the decision that Tina Hliban was not constructively dismissed by former employer Cedarglade Limited (Formerly Pineglade Limited), and her appeal failed. The determination was dated 13 July 2018. Hliban said she had no option but to resign after the company disciplined her over a €99 till shortage and later raised a €20 shortage. The Court noted that she received one verbal warning, was not accused of theft or dishonesty, and faced no disciplinary action over the €20 shortage. The Court found no fundamental breach of contract. It also found that Hliban had not used the company’s grievance procedure or Anti-Bullying Policy to give it an opportunity to address her concerns before she resigned.
