The Labour Court upheld the finding that Roman Palczynski was fairly dismissed by Keelings Soft Fruit. Its determination was signed on 9 July 2018. Palczynski appealed the Adjudication Officer's decision, which had found the dismissal fair. Palczynski said performance problems arose after he was moved to fruit picking and that he had asked to return to tunnel work. Keelings Soft Fruit said fruit picking was a core duty and that he received training and opportunities to improve after missing targets. The Court found he had repeated opportunities and additional training, most employees met the targets, and fair procedures were followed.
