The Labour Court affirmed a decision that Tony Lowe was not unfairly dismissed after finding his appeal against Ryanair Ltd was out of time. The determination was dated 6 June 2018; the merits of the dismissal claim were not decided on appeal.
Lowe argued that court staff had accepted his appeal by arranging a hearing and that problems with the online form were exceptional circumstances. Ryanair said his initial documents did not identify the decision he was appealing or meet the Court’s requirements. The Court found those documents fundamentally deficient and said no exceptional circumstances prevented a timely appeal. It declined to extend the 42-day limit, so the appeal failed and the Adjudication Officer’s decision stood.
