The Labour Court affirmed the rejection of Anna Gajewska’s unfair dismissal complaint against Wrights Of Marino Manufacturing Company Limited. In a determination dated 19 January 2018, it did not allow her appeal.
Gajewska said the company dismissed her by giving her notice in July 2015. The company said she declined another fixed-term contract and agreed to work until her replacement had been trained.
The Court found that Gajewska agreed to leave after training her replacement, whom she knew would take over her job. It concluded she had resigned by agreement and that the company’s notice gave effect to that agreement. The Court found the unfair dismissal complaint was not well founded.
