The Labour Court increased compensation for Lina Slomskiene’s unfair dismissal from €8,000 to €15,000, upholding her appeal in part. The Court’s determination was dated 26 February 2018.
C & F Automotive Limited t/a Iralco did not appeal the finding that Slomskiene was unfairly dismissed. It argued that her role ended in a genuine redundancy and that she had not taken enough steps to limit her financial losses. Her representative argued that she was unfairly selected and could have been retrained or offered seasonal or other work.
The Court found that Slomskiene had made efforts to find work but had not fully met her duty to limit her losses. It assessed her financial loss at €15,000 and ordered the company to pay that amount. The unfair dismissal finding remained in place.
