The Labour Court overturned a €5,000 unfair dismissal award to Martin Cording after allowing Tesco Ireland Limited’s appeal. The determination was dated 14 February 2018.
Cording was a team leader at Tesco’s Express store in Enfield, Co Meath. Tesco alleged he took cash from a self-service till; he denied taking any money. The Court said the appeal concerned whether Tesco was justified in dismissing him, not whether he had taken the cash.
The Court accepted that Cording should have been told in advance what a meeting on 13 November 2015 was about, but found a later investigation gave him ample opportunity to explain his actions. It concluded Tesco had reasonable grounds to dismiss him and overturned the adjudication officer’s decision. Tesco’s appeal under the Minimum Notice and Terms of Employment Act 1973 also succeeded, and that decision was overturned.
