The Labour Court rejected Joseph Mc Manus’s unfair dismissal appeal against Longford County Council, finding that he had resigned rather than been dismissed. The determination was dated 21 November 2017.
Mc Manus said he changed his mind about early retirement and asked the council to let him withdraw his resignation. The council said it had facilitated his retirement request. The Court preferred the Deputy Chief Executive’s account of a meeting at which Mc Manus sought to move his retirement date to April. It found his written resignation was clear and unconditional, and could not be withdrawn unilaterally.
