Labour Court upholds finding that Daniela Paone was not constructively dismissed

The Labour Court dismissed Daniela Paone's appeal and upheld the Adjudication Officer's finding that she was not constructively dismissed. The determination was signed on 9 November 2017. Paone said a workplace reorganisation would have left her doing lower-level claims work and demoted her role. Caci Non-Life Limited said the changes did not materially alter her role, title, salary or employment terms. The Court found Paone had not shown that the company acted unreasonably or fundamentally breached her contract. It also noted that she had not raised her concerns through the available channels before resigning.
