Labour Court upholds finding Sigita Lindermane was not unfairly dismissed

The Labour Court upheld the finding that Sigita Lindermane was not unfairly dismissed by Drimbawn Mushrooms, after finding the company had reasonable grounds to dismiss her on capability grounds. The determination was dated 1 November 2017. Lindermane said she did not understand that a December 2015 meeting could lead to dismissal and challenged the fairness of the process. Drimbawn Mushrooms said it followed its sickness absence policy and warned her that dismissal was possible. The Court found she understood the potential outcome, had an opportunity to comment and knew she could bring a representative. Her appeal failed.
