Labour Court rejects Dominic Shine’s unfair dismissal appeal against G4S

The Labour Court rejected security guard Dominic Shine’s unfair dismissal appeal against G4S Secure Solutions (Ire) Ltd, affirming the Adjudication Officer’s decision. The Court’s determination was signed on 9 October 2017. Shine said he considered himself constructively dismissed after G4S removed him from a client site following an alarm incident. The Court preferred his evidence that he spoke with the operations manager on 22 April 2016, but found that Shine knew about the grievance procedure and had not used it to give the company an opportunity to address his complaint. The Court found G4S’s conduct did not justify Shine’s resignation and that his employment had not ended by dismissal. The complaint was not well founded.
