The Labour Court dismissed Michelle O’Connor’s appeal against the finding that her constructive dismissal claim was not well founded. The determination was signed on 6 October 2017. O’Connor said family circumstances and Noonan Services Group Limited’s incorrect completion of a Carer’s Benefit form prompted her resignation. The Court found that neither personal or family circumstances nor a clerical error was sufficient to establish constructive dismissal. It also found no evidence she had raised those matters with the company before resigning. A separate appeal under the Redundancy Payments Act was withdrawn at the hearing.
