Labour Court allows Yeria’s late appeal against €20,000 award

The Labour Court allowed Yeria Limited T/A Dun Na Nog to lodge a late appeal against a €20,000 unfair dismissal award to Bolanle Adegbite. The determination was dated 8 June 2017; the Court did not decide the appeal on its merits. Yeria said it did not receive WRC correspondence at its registered address and its directors therefore did not know about the case in time to appeal. The Court found the WRC had corresponded at another address and that exceptional circumstances had prevented Yeria from appealing within the 42-day limit. Adegbite opposed the extension, saying the delay would prejudice her and she should not have to present her case again. The Court said a fresh hearing would give her the opportunity to set out her case. It extended the deadline to 16 February 2017, when the appeal was received.
