The Labour Court increased Andrea Ryan’s unfair dismissal compensation to €10,400 after allowing her appeal, up from the €3,000 awarded by the Adjudication Officer. Its determination was dated 12 June 2016.
Ryan appealed the amount, not the finding that she had been unfairly dismissed by Dse Foundation Designated Activity Company T/A Dublin School Of English (In Liquidation). The company’s liquidator did not contest the appeal or attend the hearing.
Ryan told the Court about her efforts to find work and the training she undertook to reskill. The Court found it unlikely she would secure work in the foreseeable future at more than half her former salary. It excluded the period when she was unavailable for work due to illness from its income-loss calculation, as she had not shown that sick pay or insurance would have protected her income during that time.
