The Labour Court rejected Emmanuel Ranchin’s appeal against Allianz Worldwide Care S.A. over his constructive dismissal complaint. The determination was signed on 1 December 2016 and affirmed the Adjudication Officer’s decision that the complaint was not well founded.
Ranchin, a project manager, said bullying by his manager led him to resign in June 2015. Allianz said he resigned voluntarily and raised bullying only after leaving. The Court noted that he had used the company’s grievance process earlier that year and described it as fair and professional, but had not raised a grievance before resigning. It found no reason to excuse that failure and concluded that Allianz could not be treated as having failed to address concerns Ranchin had not raised before his departure.
