The Labour Court upheld Eric Lonergan’s appeal and increased his unfair-dismissal compensation from €2,500 to €5,000. The determination was signed on 11 August 2016. Reagecon Diagnostics Limited did not appeal the finding that Lonergan was unfairly dismissed.

Lonergan said he received no warning before being selected for redundancy and had no meaningful opportunity to consider the termination terms. Reagecon said it needed to restructure, had considered redeployment and had paid severance terms Lonergan accepted.

The Court found no evidence that Reagecon had adequately considered whether Lonergan’s selection was fair or whether he could be redeployed. It also found he had no prior warning or opportunity to influence the decision. Taking account of payments already made and finding that he had mitigated his loss, the Court ordered Reagecon to pay €5,000 in compensation, in addition to termination-related payments already received.
