Labour Court affirms finding Brian McGovern was not unfairly dismissed

The Labour Court affirmed a finding that Brian McGovern was not unfairly dismissed by Expd8 Ireland T/A Tradewins. Its determination was signed on 26 July 2016, after McGovern appealed the Adjudication Officer’s decision. The Court said the employer was responsible for unacceptable treatment between February and April 2015, after asking McGovern not to return to a store in Nutgrove Shopping Centre. The parties then engaged to address the problem, and the employer confirmed McGovern remained an employee and offered him work. McGovern declined the offered schedule in June. The Court found no evidence he had been dismissed and said he had not shown he used available procedures to resolve the matter before ending the engagement.
