The Labour Court upheld an adjudication officer’s decision rejecting Ms Laisa Nadezda’s appeal against Bidvest Noonan (ROI) Limited over pay increases linked to Employment Regulation Order rates. The determination was dated 12 July 2022. Nadezda argued that Bidvest had to continue increases in her pay in line with ERO rates after she transferred from ISS Facilities. The Court found her case had the same relevant facts as an earlier case and that no contractual entitlement to the increases had been established. It therefore found the appeal must fail. The Court did not decide whether the complaint was outside the time limit.
