The Labour Court has rejected Mrs Karolina Warszewska’s appeal against Luxury Reservations Limited T/A Marriott International, finding her complaint about public holiday compensation after a transfer of employment was not well founded. The Court’s determination was dated 24 June 2022. Warszewska said that before her employment transferred from Starwood Reservations Limited on 1 April 2020, she could choose between double pay and a day in lieu for working a public holiday. The company said she continued to be compensated and that handbook policies could be changed. The Court found that employees had to state a preference each time and that double pay was the default. It concluded that the option of taking a day in lieu on some public holidays was an operational practice, not a contractual right or obligation transferred to Marriott. The Court upheld the Adjudication Officer’s decision, and the appeal failed.
