The Labour Court has rejected traffic warden Clive Jones’s appeal against Cork County Council, finding that his employment did not transfer to the Council when it took over parking services in Mallow. The determination was dated 24 June 2022. Jones worked for a contractor providing parking services for the Council. After the contract ended in April 2020, the Council took over the service. Jones argued that his employment should transfer with it; the Council said none of the contractor’s assets transferred. The Court found that no staff, assets or element of the contractor’s business identity transferred to the Council. It concluded that no undertaking transferred under the regulations, and the appeal failed.
