The Labour Court overturned a €6,500 award to Eleonor Rabonsa in a pay claim against Bidvest Noonan (ROI) Ltd, following the company’s appeal. The determination was dated 8 April 2021. Rabonsa said her contract required the company to raise her pay in line with increases to rates for the contract cleaning industry. Bidvest Noonan denied that such a contractual entitlement existed. The Court relied on its finding in a related Payment of Wages case that Rabonsa had not established an entitlement to those increases, and found no additional facts to distinguish this claim. It overturned the adjudication officer’s award under the transfer regulations.
