The Labour Court awarded Paul Grant €2,869.58 after finding Ocs One Complete Solution Limited failed to consult employees before transferring its pest-control business. In a decision dated 23 March 2018, the Court varied an earlier ruling that found a breach but awarded no compensation. Grant said he was told about the transfer on 18 January 2017, the day after it took effect, and was warned he would be out of a job if he objected. OCS said confidentiality prevented earlier consultation and that it met affected employees as soon as practicable after the transfer. The Court found the rules required consultation in good time before the transfer and did not allow that duty to be waived entirely. It directed OCS to pay four weeks’ remuneration, €2,869.58, the maximum compensation allowed for the breach.
