Labour Court rejects Conor Brennan’s late appeal against Irish Pride Bakeries

The Labour Court rejected Conor Brennan’s appeal against Irish Pride Bakeries (In Receivership) (KPMG) after finding it was filed outside the 42-day limit. The determination was dated 30 July 2018. The Court found no exceptional circumstances to extend the deadline and had no jurisdiction to hear the appeal, so the merits were not decided. The Adjudication Officer had previously found both claims not well founded. Brennan argued that his solicitor’s calculation error justified admitting the appeal. His solicitor told the Court she had relied on an online date tool that gave the wrong deadline. The respondent argued that the miscalculation was not an exceptional circumstance.
