The Labour Court affirmed a direction for Trinity Leisure Holdings Limited T/A Trinity City Hotel to pay Natalia Alfimova a premium of 30% of the basic rate for Sunday hours worked between 25 September 2013 and 24 March 2014. The determination was signed on 17 January 2017. Alfimova's appeal over an increase in her hours after the employment transfer failed because the contract allowed hours to vary with business needs. The Court also upheld complaints about technical contract omissions, but found no detriment and no compensation was merited. The parties agreed her hours returned to 35 a week from March 2015. The Labour Court rejected the hotel's cross-appeal because it offered no evidence showing what part of Alfimova's hourly rate related to Sunday work. Her Safety Statement appeal failed; the Court found no evidence of vulnerability from the lack of translation and recommended written notice and explanatory meetings after future revisions.
