Labour Court upholds worker’s complaints and awards compensation against Petrogas

By Aoife Loughran

Labour Court ·

The Labour Court upheld Edgarus Paulauskas’s appeal in part and ordered Petrogas Group Ltd to pay compensation for working-time and transfer-notice breaches. Its determination was signed on 29 August 2016. The Court also ordered a Sunday premium of time plus one third.

The Court upheld findings that Paulauskas had not received required rest periods and shop-worker breaks, and that his €22,000 annual salary was not shown to compensate him for Sunday work. It awarded €150 for the rest-period breach, €250 for the break breach and €850 for Sunday work. It also found that Petrogas had not given 30 days’ written notice of a transfer, or otherwise advised him in good time, and awarded one week’s wages for that breach.

The Court found that the company had infringed the Terms of Employment Information Act by delaying the staff handbook and ordered one week’s wages in compensation. Paulauskas’s complaints about notice of start and finish times and holiday pay were not well founded. The Labour Court’s findings added to the earlier €150 working-time award; that amount is not counted again here.
