The Labour Court found that Kevin Carroll’s complaint against Aer Lingus Limited under the transfer-of-undertakings regulations was outside the time limit. It affirmed the earlier decision and dismissed his appeal; the merits were not decided. The determination was signed on 4 July 2016. Carroll’s employment with another employer ended on 3 July 2013, and he made his complaint on 4 May 2014. He made no application to extend the time limit to the Adjudication Officer or the Court.
