The Labour Court has overturned an earlier decision and awarded Declan Gargan €4,807.69 after finding his former employer failed to provide him with written terms of employment. The award is equivalent to four weeks’ remuneration.

The decision was signed on 13 August 2024. Gargan appealed an adjudication officer’s decision that his complaint against Shapoorji Pallonji Europe Limited was not well founded. The company’s liquidator did not attend the Labour Court hearing.

Gargan began work in June 2022 and his employment ended in October 2023. The Court found that no written statement meeting the legal requirements had been issued to him during his employment. Such a statement sets out key terms of a job, giving the worker clarity about their employment conditions.

The Court found a breach of section 3 of the Terms of Employment (Information) Act and upheld the complaint. It set aside the adjudication officer’s decision and ordered the company to pay compensation of €4,807.69.
