Labour Court upholds rejection of HSE worker’s job-description complaint

The Labour Court upheld the decision rejecting Gabriel Kelly’s complaint against the Health Service Executive over the absence of a revised job description. The determination was dated 18 October 2019. Kelly said his duties had changed considerably without a revised job description, making it harder to resolve a dispute about his post’s grading. The HSE said it had met its obligations and there had been no relevant change in the fundamental aspects of his employment. The Court found the Terms of Employment (Information) Act did not explicitly require a new job description whenever an employee’s duties changed.
